The Missouri Compromise
Coming back to the beginning of the American history, when the United States consisted of only thirteen states, the representatives of the northern (lets call them as ââ¬Å"freeâ⬠) and southern (lets call them as ââ¬Å"slaveâ⬠) states had almost the equal rights in the Congress. Also, it should be pointed out that slavery problem didnââ¬â¢t arise during that period of time. However, the situation was completely changed, when the boundaries of United States approached to West. Both the northern and southern parts were worried about the advantages in the parliament, which, as it is known, was formed on the basic of the following principles: the members of House of Representatives and two deputies from each state ââ¬â the Senate. In fact, just the Senate became the main reason of the ââ¬Å"battleâ⬠between the North and South later. It should be emphasized that in the first half of the nineteenth century two main tendency or saying in other words two main ways of bourgeois development took place in the U.S.: one ââ¬â in the North, other ââ¬â in the South. So, the main questions of the second American Revolution were the following: Would the further development of capitalism in the U.S. be provided with a way of slavery destruction and would the victory of a free farmer over the slave-owning system take place in the future? Firstly, the main reason of mass contradictions and conflicts became customs tariffs. The point is that, the Northern bourgeoisie was interested in selling the production and therefore demanded high customs for the manufactured goods which were brought from abroad. Slave-holders didnââ¬â¢t support them. So, Legislative Assembly of the South Caroline state in 1832 demanded the complete cancellation of customs tariffs, threatening to disconnect from the U.S.A. The main its argument was so-called ââ¬Å"nullificationâ⬠doctrine, according to which, states can ignore the decisions of the federal authority if they didnââ¬â¢t correspond the constitution. It is clear, that such kind of explanation was very profitable for the separatism representatives, especially in the South of the country. In general, collisions of interests of industrial bourgeoisie and slave-owners led to the unavoidable conflict, which afterwards caused the civil war. à It is obvious that, the given conflict became the beginning of the very tense fight between the following economical systems: à strengthening bourgeois system and weakening slave-holding one. à On the background of the given fight, the political history of America at the period between the independence and civil wars was more visible. Also, at the beginning of the 19-th century various disagreements arose between the representatives of the following political parties: the party of federalists and the party of democrat-republicans. The first party was established by Hamilton. So, focusing on the huge bourgeoisie and successful planters, federalists didnââ¬â¢t want to support the democratization of the constitution. As to the Republican party, at the head of Jefferson, it was highly supported among the industrial bourgeoisie, small planters, farmers and craftspeople. The main purposes of the given party included: the development of bourgeois-democratic freedoms and restrictions of the huge planterââ¬â¢s activity. The beginning of the long conflict was considered to be raising a question on Missouri State. Coming back, we can see that when the territory of Missouri applied for admission to statehood, the Congress and the nation were confronted with a unique substantive question that had far-reaching implications both for the settlement and for the future political status of all the states that might be carved from the vast area acquired from France in the Louisiana Purchase of 1803. Nevertheless, despite all faced difficulties and problems Missouri managed to become a state in 1818 à à à à à à à à à à à à à à à (Bartelby, 2006, p.1). However, the settlers from Missouri also wanted their state to be a slave state. So, the question: ââ¬Å"Should slavery be allowed in the new state of Missouri?â⬠was suggested to be the most important for the citizens of that state at that moment (Blaustein, 1968, p.16). à The fact that southern slaveholders had already migrated into the Missouri territory made the question more than academic. The Congressmen from the North did not want another slave state. Also, at the same time Maine asked to be admitted to the Union ( p.17 ).à The discussion on the given problem was very dangerous for the U.S. because it could lead to the split of the country into two enemy sides. Planters tried to create the special law, according to which, the state would have to receive slave status, however they faced mass protests from the delegates of free states. Nevertheless, the given conflict was finished by the Missouri Compromise in February of 1820. As a result, the new agreement was reached, according to which, Missouri had a slave status, but the new Maine State was simultaneously accepted to statehood as a free one. Also, the territory north of 36â⬠² 30â⬠² north latitude was considered to be free ( p.17 ). Afterwards, the act of March 6, 1820 took place, according to which, fugitive slaves could be apprehended north of the compromise line and returned to their owners. As the American history showed, Missouri Compromise was regarded to be the most long-lived, because no states applied for admission to the statehood of the U.S.A. during the next thirty years. Coming to the conclusion, we can say, that obviously the acceptance of free states undermined the positions of the slave-holders in the Senate. In fact, the Missouri Compromise managed only to suspend the open battle between two economical systems. Later, it was broken when the question, which was connected with the future of such states as California, New Mexico and Utah, was raised. In 1854 the dispute over two states Kansas and Nebraska, which were located north of à à à 36â⬠² 30â⬠² north latitude touched upon the Missouri Compromise again. Bar Codes Case Essay
1. (a). A bar code is a series of lines which differ in thickness and space in between each other which contain data to provide certain information on the product such as the Manufacturer, Product Description, and the Size. The purpose of the bar code is to simplify the amount of data which the staff needs to know and recognise by memory as all of the data is stored of the company computer. (b). Information that is contained in the bar code contains are the unique ID number which is the code number. (c). Information that is not contained in the bar code would be, in most cases, the price as all different shops which stock the product might need to charge different amounts. Also would be the manufacturers name, the product description, and the size and in some cases also the price as these would all be entered into the shops computer by someone. 2. (a). The barcode is entered into the computer/register by the scanner shooting a beam of light which will interpret the barcode. Once this has been recognised as a valid product the information relating to that barcode will be received from the main computer and the relative information will be displayed/. (b). If the barcode cannot be scanned then the person at the till would enter the barcode in manually with the set of numbers which are linked with the barcode into the computer to mark the item as paid. (c). Fresh fruit, vegetables and items from the delicatessen counter are dealt by either the customer weighing and putting a unique barcode on the bag themselves or by the person at the till weighing them and then manually entering the amount to pay into the register to add onto the final bill. (d). The chip and pin process is used by a person inserting their card and putting in their pin code instead of signing the bill using their signature. When they have put in their pin code and pressed enter the computer will verify that the code that the person has entered is the same as the card code and if it is the transaction would of succeeded but it they got it wrong they will either have to do their signature or they will have to prove that their card is theirs or they could be charged with fraud. (e). After the payment has been made the supermarket computer will add all of the items bought to their reordering list so that the bulk order is read to put in once they have reached their minimum stock level. (f). Incentives that regular customers could have would be the method of a club card or loyalty/reward card which can be used to either get money off the final payment or using points towards an item for money off. They could also give out school vouchers to get either computer or PE equipment. 4. (a). Advantages to the customer of using the computers in the supermarket is that there will be less chance of any errors, and also there will be more information about the item and a faster service. (b). Disadvantages to the customer of using computers is that the computer may not be working due to technical problems and may give the wrong information or it may not be working at all. 5. The list that would be given to a student for his after school job would be on a handheld device so that he would walk round and find out what needs to be re-stocked. This would be loaded from the main computer list of what is /is not on the shelves. 6. (a). The manager can find out what stock needs to be re-ordered by checking what has been bought since the last time he checked and what ever has been bought then it would need to be re-ordered. (b). The human would check the re-order list before the order is placed to make sure that all of the items have been entered correctly and that no items had been left off the list. He also needs to verify the stock levels. 7. Stock on the shelves and in the warehouse might not match the stock file on the computer if stock had somehow been made unusable such as being damaged or if the product has expired or if the item has been stolen. 8. Advantages to the supermarkets of using computers are that they will not lose any money by making human calculated errors, (b). disadvantages to the supermarket of using computers is that the supermarket will be totally dependant on the machines and also training would be needed.

MASLOWââ¬â¢S THEORY OF HUMAN NEEDS Maslowââ¬â¢s theory of human needs focuses on the key foundation and the relations of human needs A need is a physiological or psychological deficiency that a person wants to satisfy In his theory, Maslow identified human needs and categorized them into 5 levels. These levels are physiological needs, safety needs, social needs, esteem needs and self-actualization needs. Ex: safe working conditions, job security, base compensation and benefits Social needs: Social needs are those related to interaction and belongingness with other people and include work groups, friends, family, love and affection, relationships, etc. People seek to overcome feelings of loneliness and alienation and managers must understand this to ensureà employee involvement, production and motivation. Ex: friendly coworkers, interaction with customers, pleasant supervisors Esteem needs: Esteem needs are when people desire self-esteem from both themselves and by others too. Esteem needs include achievement, mastery, respect, competence, prestige, recognition, managerial responsibility, etc. Managers who understand this can help ensure employees and team members feel valued and respected which increases their self-esteem. The Culture and Music of Puerto Rico In the first decade of American rule, Puerto Rican culture was influenced drastically by its status as a US possession. Although the political and economic aspects of American influence were very significant, American rule also had a great impact on Puerto Rican culture. This is expressed through the development of Puerto Rican music both on the island and in the United States. Puerto Rican music not only became an important cultural icon, but also helped to determine the new identity of the Puerto Rican both on the island and the mainland. Under Spanish rule, Puerto Rican music had been shaped by the prejudices of their oppressors and the divisions between the peasant class and the upper class elites. Many people argued over what was true Puerto Rican music and culture, and the more powerful members of Puerto Rican society controlled the music that represented the island. For this reason, under Spanish colonization, the occupying country recognized the most refined and European-sounding music, the danza. However, the music of the lower classes also served as a means to declare an identity separate from the Spaniards. In this way, Puerto Rican music at this time had the influence of both Europe and its own native culture. According to Glasser, "it is likely that in this way the vals, the mazurka, and other European dances penetrated much of the Puerto Rican countryside and were absorbed, with some modifications, into the jibaro repertoire. (Glasser 26)" In other words, the refined European style that was forced onto the m by Spain and other types of music became part of Puerto Rican music, and part of their culture. Puerto Rican music and culture further developed when the United States ... ...uence. In addition to this, Puerto Rican music demonstrates that although there was outside influence, the Puerto Rican identity still grew strong. This is demonstrated by the various protest songs, and the strong ties between musicians on the island and on the mainland. In the face of early US colonization, Puerto Rican culture came under the same conflicts as it did under Spanish rule, and reacted much in the same way. While US intervention may have masked the appearance of "true" Puerto Rican music and culture, the lives and the works of the Puerto Ricans themselves showed that it is possible both to accept new cultural themes and to struggle to preserve oneââ¬â¢s native culture at the same time. It is our responsibility to assist and educate new mothers on the benefits by promoting and encouraging short term and long-term benefits of breastfeeding for both mother and infant (DAD, 2009). In order to provide effective teaching to a new mother, I must take into consideration the health literacy of the mother and any cultural beliefs she may have. The educational approach must be culturally sensitive and set in an environment that is conducive to learning.An assessment made on preferred learning can assist the new mom in adhering to breastfeeding and setting aside any misconceptions, she may have. I would involve the mom and family with creating short and long-term goals and implementing strategies. Mr. Hagedornââ¬â¢s approach to control employee health care cost is through providing a wellness facility program for their employees and also creating rules concerning on health and monetary punishments to those who donââ¬â¢t want to follow these rules. From the 20% of the companyââ¬â¢s net profits for the health care and health risk assessments, the goal is to limit health care insurance costs. First, Mr. Hagedorn made a companywide wellness program which is called the LiveTotal Health program and hired a third party, Whole Health Management to run it. Next, he started encouraging his employees to take health-risk assessments and for those who donââ¬â¢t take the health risk-assessments to pay $40 per month more in premiums. And for those employees who found to be moderate to high risk through the assessments and will not comply will pay an additional $67 per month on top of the $40. As we see it, Mr. Hagedornââ¬â¢s approach is both intrusive and forceful. The employees cannot argue and are forced to comply with his requirements but his company has some rights since they are the one paying the bulk of amount for the premiums. Employees who surrender to his wellness program facility are forced to do monthly check ups and also quit smoking, drinking and other bad health habits. His approach is also very sudden, he only thought about it overnight and his type of approach needs a lot of adjustments especially for those employees who had already incorporated certain unhealthy habits into their lifestyle. His approach in controlling employee health care cost through making a wellness program facility and also letting his employees quit smoking and other bad health habits may also lead to certain losses in their organization in terms of the work/ labor force because there is a possibility that efficient and effective workers are going to be terminated because they canââ¬â¢t cope with this type of approach or they canââ¬â¢t change their habits and lifestyles and also because of the high monetary penalty if the employee canââ¬â¢t abide with his rules/approach. However, our group agrees with his approach b ecause his plan to lower health care cost through providing a wellness program facility is a win-win situation, not only can the company be able to cut costs, but also making employees live a healthier life leads to a more productive performance, improved mobility in doing their jobs and also a happier state. Being healthy means cuttingà healthier care spending in the long run. Employees could be more confident and competent in building and interacting with their customers and various stakeholders. His approach is also a motivation for the employees to be engaged in healthy living. Furthermore, they become loyal to the company, as they feel that the company considers them as an important asset to operations, values and cares for them. Mr. Hagedornââ¬â¢s approach may also attract new competent and potential employees because of the benefits they will get; because a good work environment and a healthy way of living await them in the company. Functionalism is a predominant perspective in which to analyse the British educational system. The functionalist sees education as a miniature society, where the individual develops a sense of commitment to the social group; it is a place to learn rules where the individual learns to conform to societies cultural norms and values. The functionalist perspectives of Emile Durkheim are particularly relevant to the British educational system. He believed that the major function of education was the transmission of societies norms and values. This would allow an advanced division of labour, thus contributing to economy. He believed in the process known as socialisation, where cultural norms transpose a conditioned individual, allowing entry to modern society. The economy greatly relies on educational conditioning, and it is essential that educational achievement is well balanced in the meritoractic society, for role allocation to occur. The individual must be suitably-fitted for his or her post. From a functionalist perspective schools sieve individuals in accordance to their ability for example by tiered examinations. This process in which educational failure is seen positively, aids role allocation. Parsons backed Durkheim s theory. He believed that education fulfils the function of secondary socialisation, thus allowing role allocation to occur. He firmly believed that role allocation was necessary for the functioning of society and the economy. His perspectives encouraged meritocracy, where the individual is rewarded on the basis of merit or ability. There are various conflict theories, which give different view regarding the role of education on modern Britain. For example the Marxist perspectives of education argue that the education system imposes values of a higher class origin. In addition, achievement is based merely on social background and therefore makes failure inevitable. Bowles and Gintis believed that the hidden curriculum benefits only the employer in a capitalist society, whereas a functionalist perspective would argue that without socialisation in education, the individual would not recognise the norms and values of modern society. They believed that there is a strong relationship between capitalism and the educational system. The correspondence theory of Bowles and Gents illustrates school as entry into a world of exploitive work, where the individual learns to believe in meritocracy. In contrast to a functionalist perspective, Giroux believed that the educational system is a site of ideological struggle, where the enforcement of class differences by aiding the middle class and neglecting the working class from achieving are obvious. Marxists believed that functionalism was to blame for the failure of the educational system, and because individuals are made to conform, they mostly oppose values espoused by schools. The enforcement of complacency therefore encouraged a counter school culture, the consequence of unappealing and monotonous tasks. Illch supported this view and felt that education should be an enjoyable and inspiriting institution where group work is encouraged to prevent bad behaviour and rebellion to authority. A functionalist would argue that bad behaviour, is exactly why individuals need to reform to the cultural norms of a modern day society if they are to succeed at all. A study of gender inequality in different child custody cases Essay
Gender inequality in child custody cases has been happening since custody hearings were created. Today, fathers are less likely to win custody of their children; resulting in court and legal fees that the mothers do not have to pay. Regardless of the parents living situation or income, if the mother is physically healthy enough to raise the child, she has a major advantage.à On top of everything else, men are more likely to owe increasing child support, even if they are hurt or arrested for non-payment. Itââ¬â¢s inequality like this that has plagued the family courts forever, giving them a biased and bad name. Going back to times such as the 1970s, it is well noted that even then gender inequality was quite rampant. Not only is it now well-known and admitted, but many feel with the removal of ââ¬Ëtender yearsââ¬â¢ law (feeling that women raised the children, this should be primary caregiver) that inequality was taken care of; this obviously not being the case. à ââ¬Å"Indeed, typical statutory provisions at least implicitly encourage courts to consider past parental participation. Moreover, evidence that courts continue to favor mothers in custody disputes suggests that the pre-divorce caretaking function is valued.â⬠(Elizabeth S. Scott) Not only is this seen and documented to be the same for many states; it can get even worse for small towns and municipals as their rulings have a higher chance to be biased and go unpunished and undocumented. While there are waivers to get court fees waived, many times the court rejects these fee waivers; resulting in immense costs for fathe r. If the father wants to claim custody of his child, some places may make the father file a petition for adoption (even if he is the biological father), which cost money to file. Fees for this could range from $20 to $200; something a struggling father with legal fees could usually not easily pay. With all these legal fees the father will also have to pay for any attorney fees; and for the attorney themselves. There have been many reported cases of mothers who can not support their children, being awarded custody for supposedly other reasons; while the father who could support the child is writing off as unfit. For example, there have been several cases where homeless mothers were award full custody of their children, while the father had a stable living situation. Not only living situation wise, but women who donââ¬â¢t have a stable source of income are often not seen as a problem in the eyes of the court. It operates under the guidance that women can get more government aid (such as welfare) for their children; often resulting in poor treatment of children due to improper nutrition and medical care. All of this is taking place due to courts going for what they feel would be the ââ¬Ëbest interestââ¬â¢ of the child, rather than the main negatives and benefits for each parent. More often than not, more care is done when a parent informs the court they want to move out of state with the child. This usually brings about a full inspection into both parents history, so to decide the right choice and not send a child out of state with an unfit parent. Operating on this backing is wrong, and this concept should be applied to every family court case regardless of circumstances or not. However, if a father was awarded custody, and wanted to move out of state to ââ¬Å"start fresh againâ⬠or maybe ââ¬Å"pursue love in another areâ⬠then more often than not the court would deny the father the ability to move out of state. ââ¬Å"Where I practice, a parent wishing to move with their child out of state has to pass a two-part test. Part One: show the court a legitimate reason to move. Part Two: show the court that the move is in the best interests of the child.â⬠(Nancy Shannon) More often than not courts find a problem with moving the child out of the motherââ¬â¢s state, due to incorrect thinking that all mothers are the best fit to parent their childre n; or they need to have the ability to be in contact with their children. On top of the discrimination and work required most fathers need to do in order to get custody of their child if they fail the results could end up being crippling and life ruining.à If a father is made to pay child support, right out of the court he is already in debt. Not only are the legal fees now imposed, but he now has to pay an additional monthly fee; sometimes even surpassing the cost of their monthly rent. This leads a lot of child support payers to end up not being able to pay; resulting in their arrest. What makes the entire situation worse is that once in jail their fees do not stop. The debts continue to accrue and once they get out, it could become a vicious cycle of not being able to pay, being arrested, and then being released. Yet somehow this is not the entire story of it. If you get hurt or have a medical injury making you unable to work, your payments still do not stop. You have to make a petition to the judge with proper documentation (which could be costly to print out depending on state medical information laws) and even then a judge may decide your injury is not debilitating enough. This one event in a personââ¬â¢s life could result in the rest of their life being ruined. ââ¬Å"All I was saying was, ââ¬ËGive me an opportunity instead of throwing me in jail because that just puts me further behind in child support,ââ¬â¢Ã¢â¬ Ferebee says. ââ¬Å"Let me find work so I can earn money.ââ¬â¢Ã¢â¬ This year, Ferebee was headed to jail a fifth time for failure to pay child support.â⬠(Tina Griego) This could turn your life into a ââ¬Ëdebtors prisonââ¬â¢ where there is no hope for escape, and once the process has started each day makes recovery more and more improbable. There should be more options available to the father that cannot pay; such as working the payment off in community service or being forced to an assigned job for a certain amount of payment until the balance is resolved. This not only means fewer pe ople in the jails for non-violent crimes but a better chance at actually paying the debt.à Unfortunately, the standard today is to just increase the debt hoping that the person could eventually afford it. One of the most compelling arguments against gender bias in court would have to be that because women usually take care of the children more often, they should be the primary caretaker. Several well-known judges had been surveyed about this, and many have told they feel this is not bias. Most judges are not getting a direct view of the household. That is why each case needs to be verified on a person-to-person basis, rather than a gender basis (i.e. look at BOTH the mother and father for the best living situation). ââ¬Å"Her article holds that mother preference is not a gender biased opinion if the mother was the primary caretaker of the childââ¬Å¸s past.à She writes that bias is often seen because ââ¬Å"fathersà are often given more credit than mothers for doing what is expected of mothers, to penalize mothers more than fathers for extramarital affairs, and to think that a motherââ¬Å¸s investment in her career is selfish while a fatherââ¬Å¸s is the act of a responsible providerâ⬠(Lindsay R. Estep) This quote does wonder for speaking about the current legal system regarding gender. The court official who spoke in that quote clearly demonstrates (albeit with a bit of truth in some parts) gender bias, and fails to recognize it. There are also a few things that need to be addressed regarding the quote. When the official speaks about the mother being the primary caretaker, her assumptions are wrong. If a mother was a primary caretaker of the child (i.e. father works while the mother stays at home) that does not give her any more parental rights than the father and vice versa. One of the reasonââ¬â¢s a divorce could be happening is due to the motherââ¬â¢s neglect of the child while the father was away. Going with the current logic of the court official, the neglectful mother would be given the child, due to previous caretaking. The issue is that is not just an isolated problem, many places all over experience this issue, and itââ¬â¢s met with no resistance. The correct part of the quote is true, a mother can work while the father stays at home and vice versa. If this was the case she would not, and should not be penalized. The problem with this all is nothing is being done. Even though the mass public outrage, and people standing up against bias, places like the Supreme Court fail to do anything to prevent further discrimination. ââ¬Å"No case so clearly prohibits consideration of sex in custody cases. It should be noted, however, that there was a potential gender issue in Palmore that received no attention from the Supreme Court. It appears that Linda began cohabiting with Clarence before they were married.â⬠(Katherine Bartlett) This case Is well known because it enforced and helped prove the clear gender bias of sex without marriage; regardless of if the bias was on the female ââ¬Å"Nothing more seems to have been made of this factor, either by the trial court or on review, but some courts have since noticed that mothers who cohabit outside of marriage, tend to be penalized in ways fathers who cohabit outside of marriage are not.â⬠(Katherine Bartlett) While women face the same gender bi as in some ways, in the ways people tend to care about (who gets the child, who pays fees, etc.) is where men get overlooked in quality. This quote is important because if itââ¬â¢s known and documented of a clear gender bias, why hasnââ¬â¢t the Supreme Court stepped in and introduced better legislation and guidelines to prevent further bias? The problem is old legislation, and the refusal to make a change. A currently former Supreme Court judge Antonin Scalia was quoted as saying the constitution does not dis-allow gender bias.à While not true, a Supreme Court judge, who supposedly should be speaking for the constitution, should not help spread and promote miss-information. On top of that, he was never corrected or reprimanded.à The only consequence of that action was ââ¬Ëbad pressââ¬â¢. This quote not only helps smaller local courts continue their bias but miss-informs them that they are acting legally.à Better legislation and better education for judges need t o be passed before anything can be done. And while there are many arguments that women also face these problems (and while that may be true) the problem itââ¬â¢s usually the men. Women are given more chances and exceptions than the men. Several document court cases have shown that on average women are given more chances to earn money and pay it, should they be ordered to pay child support. This could either be the judge informing them of state opportunities like welfare and social security, unlike the men who usually are faced with arrest threats or an actual arrest. Another idea in the system is that the reason they are in family court is often due to the father being unfit in the first place (I.e Domestic violence, threats, abuse). This is an obvious oversight into a small population of the people.à More often than not itââ¬â¢s just a case of a family not working well together, and no actual abuse or crimes have taken place. On top of that, when it comes to dishing out child support, the mother will likely have t he advantage; also awarded more money ââ¬Å"In spring 1992, about one-half (6.2 million) of the 11.5 million custodial parents were awarded child support; award rates were higher for mothers than for fathers (56 percent compared with 41 percent)â⬠(U.S. Department of Commerce) Overall, when it comes to dealing with the family courts, men are less likely to win custody of their own children. Those who have a chance at it, are often met with extreme legal fees more so than the mother. Women are often seen as a childââ¬â¢s protector so in the eyes of the court they are usually seen as the fit parent right from the start. It has also been noted that menââ¬â¢s job status and living situation is looked into more than the womenââ¬â¢s. This is due to the assumption that women get more government aid to assist them than men; this not being true but is still a common misconception. Inequality in the courts has been taking place ever since they have been around. Today, fathers are less likely to win custody of their children; resulting in court and legal fees that the mothers do not have to pay. Regardless of the parents living situation or income, if the mother is physically healthy enough to raise the child, she has a major advantage.à On top of everything else, men are more likely to owe increasing child support, even if they are hurt or arrested for non-payment. Itââ¬â¢s inequality like this that has plagued the family courts forever, giving them a biased and bad name. Going back to times such as the 1970s, it is well noted that even then gender inequality was quite rampant. Not only is it now well-known and admitted, but many feel with the removal of ââ¬Ëtender yearsââ¬â¢ law (feeling that women raised the children, this should be primary caregiver) that inequality was taken care of; this obviously not being the case. à ââ¬Å"Indeed, typical statutory provisions at least implicitly encourage courts to consider past parental participation. Moreover, evidence that courts continue to favor mothers in custody disputes suggests that the pre-divorce caretaking function is valued.â⬠(Elizabeth S. Scott) Not only is this seen and documented to be the same for many states; it can get even worse for small towns and municipals as their rulings have a higher chance to be biased and go unpunished and undocumented. While there are waivers to get court fees waived, many times the court rejects these fee waivers; resulting in immense costs for fathe r. If the father wants to claim custody of his child, some places may make the father file a petition for adoption (even if he is the biological father), which cost money to file. Fees for this could range from $20 to $200; something a struggling father with legal fees could usually not easily pay. With all these legal fees the father will also have to pay for any attorney fees; and for the attorney themselves. There have been many reported cases of mothers who can not support their children, being awarded custody for supposedly other reasons; while the father who could support the child is writing off as unfit. For example, there have been several cases where homeless mothers were award full custody of their children, while the father had a stable living situation. Not only living situation wise, but women who donââ¬â¢t have a stable source of income are often not seen as a problem in the eyes of the court. It operates under the guidance that women can get more government aid (such as welfare) for their children; often resulting in poor treatment of children due to improper nutrition and medical care. All of this is taking place due to courts going for what they feel would be the ââ¬Ëbest interestââ¬â¢ of the child, rather than the main negatives and benefits for each parent. More often than not, more care is done when a parent informs the court they want to move out of state with the child. This usually brings about a full inspection into both parents history, so to decide the right choice and not send a child out of state with an unfit parent. Operating on this backing is wrong, and this concept should be applied to every family court case regardless of circumstances or not. However, if a father was awarded custody, and wanted to move out of state to ââ¬Å"start fresh againâ⬠or maybe ââ¬Å"pursue love in another areâ⬠then more often than not the court would deny the father the ability to move out of state. ââ¬Å"Where I practice, a parent wishing to move with their child out of state has to pass a two-part test. Part One: show the court a legitimate reason to move. Part Two: show the court that the move is in the best interests of the child.â⬠(Nancy Shannon) More often than not courts find a problem with moving the child out of the motherââ¬â¢s state, due to incorrect thinking that all mothers are the best fit to parent their childre n; or they need to have the ability to be in contact with their children. On top of the discrimination and work required most fathers need to do in order to get custody of their child if they fail the results could end up being crippling and life ruining.à If a father is made to pay child support, right out of the court he is already in debt. Not only are the legal fees now imposed, but he now has to pay an additional monthly fee; sometimes even surpassing the cost of their monthly rent. This leads a lot of child support payers to end up not being able to pay; resulting in their arrest. What makes the entire situation worse is that once in jail their fees do not stop. The debts continue to accrue and once they get out, it could become a vicious cycle of not being able to pay, being arrested, and then being released. Yet somehow this is not the entire story of it. If you get hurt or have a medical injury making you unable to work, your payments still do not stop. You have to make a petition to the judge with proper documentation (which could be costly to print out depending on state medical information laws) and even then a judge may decide your injury is not debilitating enough. This one event in a personââ¬â¢s life could result in the rest of their life being ruined. ââ¬Å"All I was saying was, ââ¬ËGive me an opportunity instead of throwing me in jail because that just puts me further behind in child support,ââ¬â¢Ã¢â¬ Ferebee says. ââ¬Å"Let me find work so I can earn money.ââ¬â¢Ã¢â¬ This year, Ferebee was headed to jail a fifth time for failure to pay child support.â⬠(Tina Griego) This could turn your life into a ââ¬Ëdebtors prisonââ¬â¢ where there is no hope for escape, and once the process has started each day makes recovery more and more improbable. There should be more options available to the father that cannot pay; such as working the payment off in community service or being forced to an assigned job for a certain amount of payment until the balance is resolved. This not only means fewer pe ople in the jails for non-violent crimes but a better chance at actually paying the debt.à Unfortunately, the standard today is to just increase the debt hoping that the person could eventually afford it. One of the most compelling arguments against gender bias in court would have to be that because women usually take care of the children more often, they should be the primary caretaker. Several well-known judges had been surveyed about this, and many have told they feel this is not bias. Most judges are not getting a direct view of the household. That is why each case needs to be verified on a person-to-person basis, rather than a gender basis (i.e. look at BOTH the mother and father for the best living situation). ââ¬Å"Her article holds that mother preference is not a gender biased opinion if the mother was the primary caretaker of the childââ¬Å¸s past.à She writes that bias is often seen because ââ¬Å"fathersà are often given more credit than mothers for doing what is expected of mothers, to penalize mothers more than fathers for extramarital affairs, and to think that a motherââ¬Å¸s investment in her career is selfish while a fatherââ¬Å¸s is the act of a responsible providerâ⬠(Lindsay R. Estep) This quote does wonder for speaking about the current legal system regarding gender. The court official who spoke in that quote clearly demonstrates (albeit with a bit of truth in some parts) gender bias, and fails to recognize it. There are also a few things that need to be addressed regarding the quote. When the official speaks about the mother being the primary caretaker, her assumptions are wrong. If a mother was a primary caretaker of the child (i.e. father works while the mother stays at home) that does not give her any more parental rights than the father and vice versa. One of the reasonââ¬â¢s a divorce could be happening is due to the motherââ¬â¢s neglect of the child while the father was away. Going with the current logic of the court official, the neglectful mother would be given the child, due to previous caretaking. The issue is that is not just an isolated problem, many places all over experience this issue, and itââ¬â¢s met with no resistance. The correct part of the quote is true, a mother can work while the father stays at home and vice versa. If this was the case she would not, and should not be penalized. The problem with this all is nothing is being done. Even though the mass public outrage, and people standing up against bias, places like the Supreme Court fail to do anything to prevent further discrimination. ââ¬Å"No case so clearly prohibits consideration of sex in custody cases. It should be noted, however, that there was a potential gender issue in Palmore that received no attention from the Supreme Court. It appears that Linda began cohabiting with Clarence before they were married.â⬠(Katherine Bartlett) This case Is well known because it enforced and helped prove the clear gender bias of sex without marriage; regardless of if the bias was on the female ââ¬Å"Nothing more seems to have been made of this factor, either by the trial court or on review, but some courts have since noticed that mothers who cohabit outside of marriage, tend to be penalized in ways fathers who cohabit outside of marriage are not.â⬠(Katherine Bartlett) While women face the same gender bi as in some ways, in the ways people tend to care about (who gets the child, who pays fees, etc.) is where men get overlooked in quality. This quote is important because if itââ¬â¢s known and documented of a clear gender bias, why hasnââ¬â¢t the Supreme Court stepped in and introduced better legislation and guidelines to prevent further bias? The problem is old legislation, and the refusal to make a change. A currently former Supreme Court judge Antonin Scalia was quoted as saying the constitution does not dis-allow gender bias.à While not true, a Supreme Court judge, who supposedly should be speaking for the constitution, should not help spread and promote miss-information. On top of that, he was never corrected or reprimanded.à The only consequence of that action was ââ¬Ëbad pressââ¬â¢. This quote not only helps smaller local courts continue their bias but miss-informs them that they are acting legally.à Better legislation and better education for judges need t o be passed before anything can be done. And while there are many arguments that women also face these problems (and while that may be true) the problem itââ¬â¢s usually the men. Women are given more chances and exceptions than the men. Several document court cases have shown that on average women are given more chances to earn money and pay it, should they be ordered to pay child support. This could either be the judge informing them of state opportunities like welfare and social security, unlike the men who usually are faced with arrest threats or an actual arrest. Another idea in the system is that the reason they are in family court is often due to the father being unfit in the first place (I.e Domestic violence, threats, abuse). This is an obvious oversight into a small population of the people.à More often than not itââ¬â¢s just a case of a family not working well together, and no actual abuse or crimes have taken place. On top of that, when it comes to dishing out child support, the mother will likely have t he advantage; also awarded more money ââ¬Å"In spring 1992, about one-half (6.2 million) of the 11.5 million custodial parents were awarded child support; award rates were higher for mothers than for fathers (56 percent compared with 41 percent)â⬠(U.S. Department of Commerce) Overall, when it comes to dealing with the family courts, men are less likely to win custody of their own children. Those who have a chance at it, are often met with extreme legal fees more so than the mother. Women are often seen as a childââ¬â¢s protector so in the eyes of the court they are usually seen as the fit parent right from the start. It has also been noted that menââ¬â¢s job status and living situation is looked into more than the womenââ¬â¢s. This is due to the assumption that women get more government aid to assist them than men; this not being true but is still a common misconception. Inequality in the courts has been taking place ever since they have been around.
